CalTix Terms of Service

Welcome to CalTix. These Terms of Service (“Terms”) govern your access to and use of the CalTix website, mobile applications, and online ticketing services (collectively, the “Platform”). By purchasing a ticket, creating an account, or using our Platform, you agree to these Terms. If you do not agree, please do not use CalTix.

1. Nature of the Ticket: A License, Not Property

  • Your Ticket is a Revocable License: Buying a ticket gives you the right to attend a specific show at a specific time. A ticket is a revocable license, not property. We (or the event organizer) reserve the right to revoke this license and refuse admission or eject any person whose conduct violates event rules, local laws, or these Terms.

2. Fair Access & Prohibition of Bots

  • Tickets are for Real Fans: Don’t use bots, scripts, or ticket-buying software, and don’t try to get around our queues, limits, or security. This isn’t just our rule — it’s federal law under the BOTS Act (Better Online Ticket Sales Act).
  • Purchase Limits: You may be subject to limits on the number of tickets you can purchase per event or account. Circumventing these limits (such as using multiple accounts or payment methods) is strictly prohibited.

3. Ticket Cancellations & Invalidations

  • When We Can Cancel a Ticket: We can void a ticket and refuse entry if it was bought with a stolen or reversed payment, obtained by fraud or bots, or is being used in a way that puts other fans at risk.
  • Refunds on Cancellation: If we void a ticket for a reason that wasn’t fraud or illegal activity, we’ll refund what you paid us. If a ticket is canceled due to fraudulent behavior or bot usage, no refund will be issued.

4. Transferring & Reselling Tickets

  • Passing Your Ticket to Someone Else: Can’t make it? Just click the “View & Manage Order” button in your ticket email.  That will take you to a page on our website where you can reassign one of more of your tickets to another person.
  • Honest Listing: When you list a ticket for transfer or resale, you must be honest about the price, seat location, and ticket status.

5. Fraud Prevention & Authorized Sales

  • Don’t Get Scammed, and Don’t Scam: Buy only from us or our official channels. Sites that copy our name, logo, or look are not CalTix, and prices there are often marked way up.
  • No Speculative Selling: Don’t sell or offer to sell a ticket you don’t actually have in your possession yet (speculative listing), and don’t misrepresent what you’re selling.

6. Pricing & Transparent Fees

  • What You Pay is What You See: We show the full price, including fees, before you pick your tickets. No surprises at the last screen.
  • Errors: If an error occurs in the pricing or processing of your ticket order, CalTix reserves the right to correct the error and reissue the ticket at the correct price or cancel the order for a full refund.

7. Account Security & Use

  • You are responsible for maintaining the confidentiality of your account login details.
  • You are responsible for all activities that occur under your account. CalTix is not liable for losses caused by unauthorized access to your account.

8. Event Cancellations, Postponements, & Refunds

  • Canceled Events: If an event is canceled entirely and not rescheduled, CalTix will automatically refund the purchase price (including applicable fees) to the original payment method, subject to event organizer policies.
  • Postponed or Rescheduled Events: If an event is postponed, your ticket will remain valid for the new date. Refund policies for rescheduled events are set by the event organizer.

9. Intellectual Property

All content, trademarks, logos, software, and designs on the CalTix Platform are the property of CalTix or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy or reproduce any content without explicit written consent.

10. Limitation of Liability & Disclaimers

  • As-Is Provision: The Platform is provided on an “as is” and “as available” basis without warranties of any kind.
  • Liability Cap: To the maximum extent permitted by law, CalTix shall not be liable for indirect, incidental, special, or consequential damages resulting from your use of the Platform or attendance at an event. CalTix’s total liability for any claim shall not exceed the total amount paid by you for the ticket in question.

11. Dispute Resolution & Governing Law

  • Arbitration & Class Action Waiver: Any disputes arising out of or related to these Terms or your use of CalTix will be resolved through binding individual arbitration, rather than in court. You waive any right to participate in a class action lawsuit or class-wide arbitration.
  • Governing Law: These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of CalTix after changes are posted constitutes acceptance of the updated Terms.
